Please read these Terms of Service ("Terms") carefully before purchasing or using any report or service provided by Diamond Data Co. ("Company," "we," "us," or "our"). By submitting payment and using our services, you ("Customer," "you," or "your") agree to be bound by these Terms in their entirety. If you do not agree, do not use our services.
Diamond Data Co. provides data-informed player feedback reports ("Reports") based on statistics and narrative information submitted by the Customer. Reports are produced for informational and developmental reference purposes only. Diamond Data Co. is not a licensed scouting organization, certified athletic trainer, sports medicine provider, or recruiting service. Nothing in any Report constitutes a professional scouting evaluation, medical assessment, diagnosis, treatment recommendation, or guarantee of athletic performance, recruiting attention, or advancement at any level of play.
Reports are generated based solely on data provided by the Customer, including but not limited to GameChanger CSV exports, Perfect Game profile URLs, and parent-submitted narrative accounts of tournament performance. Diamond Data Co. does not independently verify the accuracy, completeness, or authenticity of any submitted data. The Company assumes no responsibility for errors, omissions, or inaccuracies in any Report resulting from incorrect, incomplete, or misleading information provided by the Customer.
Any recovery programming, arm care guidance, physical conditioning recommendations, or drill-related content included in a Report is general educational information only. It does not constitute medical advice, physical therapy, athletic training, or treatment of any kind. Customers should consult a licensed physician, orthopedic specialist, athletic trainer, or other qualified healthcare professional before beginning any physical training program or recovery protocol, particularly following injury, illness, or surgical procedure. Diamond Data Co. expressly disclaims all liability for any injury, harm, or adverse outcome arising from the use of, or reliance on, any physical activity, conditioning, or recovery content contained in a Report.
Nothing in any Report constitutes a representation, warranty, or guarantee regarding a player's recruiting prospects, college placement, draft eligibility, or future athletic opportunity at any level. Diamond Data Co. has no affiliation with Perfect Game USA, GameChanger, any college or university, or any professional sports organization. Any reference to third-party platforms, events, or organizations is for informational context only and does not imply endorsement or affiliation.
Reports may include links to third-party video content hosted on YouTube or other platforms. Diamond Data Co. does not own, control, or guarantee the availability, accuracy, or continued accessibility of any third-party content. The inclusion of a link does not constitute an endorsement of the channel, creator, or content. Diamond Data Co. is not liable for the removal, modification, or unavailability of any third-party resource after a Report is delivered.
To the fullest extent permitted by applicable law, Diamond Data Co., its owners, operators, employees, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any kind arising out of or related to your use of, or inability to use, our services or Reports, including but not limited to physical injury, loss of athletic opportunity, reliance on Report content, or failure of third-party links or resources. Your sole remedy for dissatisfaction with any Report is to discontinue use of the service.
All Reports and services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Diamond Data Co. makes no warranty that Reports will be error-free, complete, or suitable for any specific purpose.
All sales are final. Due to the digital and time-sensitive nature of our Reports, we do not offer refunds once a Report has been delivered to the email address provided at checkout. In the event that a Report is not delivered within 48 hours of confirmed payment, the Customer should contact us at hello@diamonddataco.com and we will resolve the issue promptly. Season package purchases are non-refundable after the first Report in the package has been delivered.
By purchasing a Report that includes physical training, drill, or recovery content, you acknowledge and accept that participation in any athletic activity carries inherent risk of injury. You voluntarily assume all such risks on behalf of yourself and any minor for whom you are a parent or legal guardian. You agree to release, indemnify, and hold harmless Diamond Data Co. from any and all claims, damages, or losses arising from participation in any activity described or recommended in a Report.
Diamond Data Co. reports are designed to supplement a player's existing baseball program — not to replace it. Drill recommendations and recovery guidance are intended to support independent development between team practices, lessons, and organized events. Nothing in any Report should be interpreted as a substitute for the instruction, guidance, or direction of a player's coach, instructor, or training staff. Parents and players are encouraged to share Report content with their coaches and to use it as a starting point for conversation, not as a standalone development plan.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Volusia County, Florida.
Diamond Data Co. reserves the right to modify these Terms at any time. Updated Terms will be posted at diamonddataco.com/terms. Continued use of our services after any modification constitutes acceptance of the revised Terms.
